The Verkhovna Rada has registered Draft Law No. 13335, which allows for temporary employment and the reservation of military conscripts who have incorrect or missing military registration documents. The initiative was spearheaded by deputies, particularly the head of the “Servant of the People” faction, Davyd Arakhamia, and the head of the National Security Committee, Oleksandr Zavitnevych.<\/p>\n\n\n\n
Which categories will be subject to change?<\/p>\n\n\n\n
The changes will affect critically important enterprises and organizations, primarily in the defense and industrial sectors. The draft law provides for the possibility of temporary reservation of employees who:<\/p>\n\n\n\n
Do not have a military registration document, or it is issued improperly;<\/p>\n\n\n\n
are not registered in the military register;
have not reported personal data specified in Law 3633-IX;
are wanted by military commissariats (except persons suspected of crimes under Articles 336 and 337 of the Criminal Code of Ukraine).
Temporary reservation<\/p>\n\n\n\n
The reservation will be valid for up to 45 calendar days from the date of the employment contract’s conclusion but no more than once a year. This will allow enterprises to attract employees to perform tasks more quickly.<\/p>\n\n\n\n
Employment without a military document will be legal.<\/p>\n\n\n\n
The changes will also make adjustments to labor legislation. It is planned to allow the conclusion of an employment contract for the period of the probationary period with persons who:<\/p>\n\n\n\n
Do not have a military registration document;<\/p>\n\n\n\n
Are not registered with the CCC, SBU, or intelligence agencies.
Thus, the absence of documents will not be considered a violation on the part of the employer.<\/p>\n\n\n\n
Possibility of dismissal for inappropriate documents<\/p>\n\n\n\n
If an employee fails to correct their documents by the law’s requirements during the probationary period, the employer may dismiss them at their discretion.<\/p>\n\n\n\n
Reasons for introducing the law<\/p>\n\n\n\n
The authors of the bill note that during the booking process for employees of critical enterprises, situations arise in which individuals receive summonses during data verification or even before the booking is approved. New regulations should address this issue.<\/p>\n\n\n\n
