Olena Ivanovska, Commissioner for the Protection of the State Language, expressed the opinion that there is currently no need to increase fines or strengthen sanctions for violations of language legislation. She described this position in a conversation with the Interfax-Ukraine agency.<\/p>\n\n\n\n
She noted that the current Code of Ukraine on Administrative Offenses provides for the consideration of cases only against individuals. However, with the adoption of the new Administrative Code, a clear division of responsibility between individuals and legal entities is planned, which will allow for the establishment of differentiated fines.<\/p>\n\n\n\n
“If the new code is adopted, it will contain a distinction between liability for individuals and legal entities. This will mean different sizes of fines. After all, you must agree, a fine for a large company and for an individual cannot be the same in impact,” Ivanovska explained.<\/p>\n\n\n\n
She also emphasized that punishments should not be the goal of her activities, and fines are a last resort.<\/p>\n\n\n\n
“But in cases where a person knowingly violates the law, the state must react. It is important that the responsibility is not only individual, but also corporate, if a business commits the violation,” Ivanovska added.<\/p>\n\n\n\n
When it came to the need to increase fines, Ivanovska noted that in the current conditions of war, when many people are losing their loved ones and property, this is inappropriate. “Our language policy should be aimed at support and unity, not fear of punitive measures,” she summarized.<\/p>\n\n\n\n
She noted that the current fines are effective, but do not need to be increased. For the first violation of the law “On Ensuring the Functioning of the Ukrainian Language as the State Language”, the acceptable range is from 3,400 to 8,500 hryvnias, for a second violation, from 8,500 to 11,900 hryvnias.<\/p>\n\n\n\n
In the period from 2022 to 2025, 127 fines were imposed for violations of language legislation, including:<\/p>\n\n\n\n
9 penalties for 27.2 thousand hryvnias in 2022;
21 penalties for 85 thousand hryvnias in 2023;
