Sometimes a person may encounter a situation where it becomes physically impossible to continue working \u2014 not because of reluctance, but because of health problems. In such cases, the legislation allows for early retirement provided that the medical commission confirms that working in the specialty is harmful to health.<\/p>\n\n\n\n
According to the Pension Fund of Ukraine, the right to early retirement is granted to those who were dismissed for health reasons. Fulfillment of the main condition \u2014 no more than one and a half years should remain before reaching retirement age, and the length of service should be at least 35 years for men and 30 years for women.<\/p>\n\n\n\n
To prove their incapacity for work, the employee must provide one of the following types of medical documents:<\/p>\n\n\n\n
Having received the appropriate document, the employer must try to transfer the employee to another vacancy, if one exists. In the absence of vacancies or if the employee refuses, the employer has the right to dismiss him in accordance with Article 40 of the Labor Code of Ukraine.<\/p>\n\n\n\n
In this case, a person can apply to the Pension Fund branch for early retirement. A copy of the medical certificate and a standard package of documents must be attached to the application.<\/p>\n\n\n\n
Thus, the state supports persons who have lost their ability to work so that they are not left without financial resources. It is essential that the dismissal occurs no earlier than 1.5 years before reaching retirement age, and that all documents are correctly executed.<\/p>\n\n\n\n
