When applying for a bank card, many customers focus on promotions and tariffs rather than the terms of the agreement they sign. Meanwhile, the relationship between banks and customers is often caused by these provisions that consumers sign.<\/p>\n
Lawyer and banking law specialist Darya Bronnikova analyzed the agreements of the five largest banks in Ukraine: PrivatBank, Oschadbank, Ukreximbank, Raiffeisen Bank, and PUMB.<\/p>\n
Most financial institutions use a public agreement on accession. This means that the client cannot change the terms – he either accepts them or refuses the services. The texts of agreements and tariffs are available on websites or in mobile applications, and consent is recorded with one click.<\/p>\n
This format also gives the bank the right to unilaterally change the terms of service, as indicated in the agreement.<\/p>\n
Changing tariffs without informing<\/p>\n
One of the most critical points is the bank’s ability to adjust the card’s tariffs or rules for use. Typically, the client is notified of changes through an update in the application or on the website. If the client does not follow these changes, it is considered that he has accepted the new terms.<\/p>\n
This may result in new fees, increased service costs, or a change in the credit limit.<\/p>\n
Paid services on “free” cards<\/p>\n
Even cards advertised as “free” may include paid services, such as SMS notifications, cash withdrawal fees, transfers to other banks’ cards, currency transactions, or service fees after the grace period ends.<\/p>\n
Lawyers advise paying attention not only to advertising materials, but also to the complete list of tariffs, which can be much broader.<\/p>\n

Various provisions may allow the use of data for marketing purposes, and the wording in contracts is often quite general, expanding banks’ ability to use this information.<\/p>\n
Blocking accounts<\/p>\n
Banks have the right to stop operations or block accounts if there are suspicions about transactions. Customers may be required to provide documents to confirm the origin of funds, and in some cases, the account may be closed without a detailed explanation of the reasons.<\/p>\n
Experts recommend retaining large receipts to avoid delays in accessing funds.<\/p>\n
Liability for fraud<\/p>\n
Many contracts require the customer to be responsible for all transactions until the bank is officially notified of the loss or theft of the card. If the bank believes the card has been misused, reimbursement may be denied.<\/p>\n
Automatic approval for a credit limit<\/p>\n
Some banks automatically require customers to agree to a credit limit when applying for a card. The credit agreement comes into effect from the moment the limit is activated, even if the client did not plan to use the loans.<\/p>\n
This can lead to interest charges, penalties for delays, and deterioration of credit history.<\/p>\n
Fines and dispute resolution<\/p>\n
The agreements often stipulate fines even for minor violations of payment terms, as well as requirements for limited deadlines for filing complaints. In some cases, the client himself must prove his innocence in disputed situations.<\/p>\n
Experts emphasize that the main risks are associated not so much with the cards as with the terms of the agreements, which many users do not read. It is recommended to carefully study the terms of the public offer and the tariffs, keep copies of the documents, monitor correspondence from the bank, and refuse the credit limit if it is not needed.<\/p>\n
