The Boryspil City District Court of the Kyiv Region adopted this decision.<\/p>\n<p>The court case involved a woman who left Ukraine at the start of the full-scale invasion and went to Bulgaria. From October 2022 to December 31, 2024, she accumulated a debt of UAH 9,233. During the hearing, she stated she was not physically in Ukraine and presented her foreign passport as proof.<\/p>\n<p>The woman claimed that she did not use communal services, including water, an elevator, and household infrastructure. However, the court ruled in favor of the Association of co-owners of the &#8220;Happy Meters&#8221; apartment building, noting that ownership of real estate imposes financial obligations on the owner that do not disappear upon moving abroad.<\/p>\n<p>The debt includes expenses for maintaining the house and the surrounding area (janitor work, repair of communications, lighting of entrances), centralized heating, and removal of solid household waste. The court ordered the woman to pay the debt to the condominium.<\/p>\n<p>According to OpenDatabot, this problem affects a large part of the population. Last year, 28.3% of all civil cases in courts were related to non-payment of utility bills, while bank loan cases accounted for only 12%.<\/p>\n<p>Lawyers emphasize that, even if the home was not damaged and is not located in a war zone, the owners are obliged to pay &#8220;fixed&#8221; utility services. This includes building management, central heating, and a gas bill. However, it is possible to be exempt from paying for water, electricity, and gas as commodities, provided that the meters show zero consumption or there is a certificate of non-residence.
