In the context of general mobilization in Ukraine, the issue of passing a military medical commission (MMC) becomes especially relevant for those liable for military service. It is important to note that not all summonses for a medical examination meet the requirements of the law, and citizens have the opportunity to protect their rights.<\/p>\n
Lawyer Yaroslav Khlivny noted in his commentary that the legislation clearly prescribes the conditions under which a person can be sent to a MMC. In particular, those who have an active deferment cannot be forcibly sent for a medical examination.<\/p>\n
However, there are exceptions. According to the lawyer, persons with disabilities, as well as those whose temporary incapacity or limited fitness has expired, are required to pass a medical commission to determine their current state of health.<\/p>\n
It is especially important to emphasize that the current deferment protects a person from being forced to appear at a MMC. If its term has not yet expired, a person should not be forced to undergo a medical examination, except in exceptional cases, for example, for voluntary entry into a contract or a repeated medical examination after the commission’s decisions.<\/p>\n
The lawyer also drew attention to the frequent confusion between the terms “deferral” and “reservation”. In practice, this leads to the fact that persons reserved at work can be sent to the VLK, while pronos for those who have a deferral are not mandatory.<\/p>\n
If a citizen receives a summons to a medical commission that he considers unlawful, he has the right to appeal it in court.
