The Kyiv City Prosecutor’s Office successfully brought a case against the owner of the Galera hotel and restaurant complex, which was built without proper permits on the territory of a water fund.<\/p>\n\n\n\n
This complex is located in the Dnieper coastal protection zone on Naberezhno-Korchuvatska Street in the Holosiivskyi district of Kyiv. The Northern Commercial Court of Appeal partially satisfied the prosecutor’s office’s claim, ordering the owner to demolish the illegally constructed facilities and return the land plot to the territorial community’s ownership.<\/p>\n\n\n\n
The Galera complex consists of a two-story hotel, a restaurant with a terrace, a hookah bar, a spa zone, a swimming pool, and recreation areas. Its construction without the necessary permits on a plot belonging to the Ukrainian Water Fund is contrary to environmental standards since construction in coastal protection zones is prohibited.<\/p>\n\n\n\n
The establishment’s owner tried to register ownership of the facility, relying on the district court’s decision, which was later overturned. At the time of the cancellation, this decision had already allowed the company to conduct commercial activities on this site.<\/p>\n\n\n\n
The land lease agreement of 2018 was obtained without participating in an open competition, which is a violation. The use of the site for the construction of the restaurant was accompanied by restrictions on residents’ access to the river, which is also a violation of the law.<\/p>\n\n\n\n
Despite this, in 2024, the Kyiv City Council extended the lease agreement for 15 years, which forced the prosecutor’s office to file a lawsuit with the court demanding the dismantling of illegal structures and the return of the land to the community.<\/p>\n\n\n\n
The court found the lease illegal because it ignored environmental regulations and ordered the owner to demolish the facilities built without permits.<\/p>\n\n\n\n
When journalists arrived at the scene, “Galera” continued its activities, and the institution’s administrator refused to comment on the situation.<\/p>\n\n\n\n
Investigative actions are ongoing, and prosecutors promise to continue the fight for the execution of the court decision and the return of the land plot. The owner of “Galera” is also suspected of several criminal offenses, including unauthorized occupation of the land plot, fraud, and forgery of documents.<\/p>\n","protected":false},"excerpt":{"rendered":"
