Mobilization of persons with disabilities: when the CCC will not make exceptions

In Ukraine, persons with disabilities are exempt from mobilization by current legislation. However, there are essential details that may affect those liable for military service.

According to Article 23 of the Law of Ukraine, “On Mobilization Training and Mobilization,” persons with an officially recognized disability status are exempt from conscription. This also applies to those to whom the military medical commission has assigned a re-examination in 6-12 months. During this period, such persons are exempted from military service.

At the same time, upon the request of a person with a disability, they may sign a contract with the Armed Forces of Ukraine, as specified in the third part of the article above.

Lawyer Myroslava Mostova emphasized that previously, medical and social expert commissions independently transferred data to territorial recruitment and social support centers (TCK). However, now that these commissions have been abolished, people with disabilities need to ensure that their data is provided personally. Otherwise, the CCC may not be aware of the grounds for exemption from mobilization.

This applies especially to those who had a disability of group 1 or 2 before the war but were not on military registration. They must register and provide documents about their disability, after which they will be recognized as unfit for service without having to re-pass the VLK.

If a person has a lifelong disability of group 1 or 2 and has updated their military data, they will be recognized as unfit for military service.

The situation with persons with a disability in group 3 is somewhat different. These individuals are considered temporarily unfit or limitedly fit. They must pass a re-VLK by June 5 if it is indicated that the examination is to take place in six months or a year.

Individuals with limited fitness can receive a referral to the commission through the CCC or by using the “Reserve+” service. In case of failure to appear, they may face fines.

Let us recall that most searches are illegal; in this context, the lawyer noted that the CCC and the police have restrictions on their actions.
