Lawsuits from the CCC against Ukrainians: possibility of imprisonment in a pre-trial detention center for failure to appear
Employees of territorial recruitment and social support centers have developed a new mechanism for influencing those who evade mobilization. They have begun to initiate lawsuits against violators. Lawyers report this.
Lawyer Yuriy Ayvozyan emphasized the seriousness of the consequences if a person refuses to participate in the trial. In case of ignoring the summons, a conscript may be forcibly taken to court.
“In the most serious cases, the court may decide to apply a preventive measure in the form of arrest until a decision is made,” the lawyer emphasized.
Thus, citizens who do not respond to the calls of the territorial recruitment center risk falling under legal proceedings – the CCC has the right to initiate appropriate cases.
One of the women sought legal advice, asking about the consequences that a person who ignores the summons may face. “Such a person can be forcibly brought to a meeting or put on the wanted list,” Ayvozyan replied.
He also warned that if a person does not appear in court, there may be grounds for choosing a preventive measure, which may include arrest. Thus, evading court appearances can lead to serious consequences.
According to the legislation, the CCC can file lawsuits on several grounds, which are most often related to violations of the rules of military registration and mobilization. The most common reasons are illegal conscription, the conscription of persons entitled to a deferral, violation of the procedure for passing a military medical commission, and failure to comply with the requirements of the CCC.
