Ukrainians can be convicted for sending intimate photos to partners: the image is considered to be the production of pornography

In Ukraine, there is criminal liability for exchanging “intimate” photos. Even if you send such images to your partner, this can lead to serious legal consequences.

Lawyer Serhiy Starenky stated this in an interview on the “Kyiv24” channel. He noted that, even though both parties have reached the age of majority and have mutual consent, the Criminal Code treats such actions as the distribution of pornography. If a person sends nude photos that can be classified as pornographic, he faces criminal liability.

According to Article 301 of the Criminal Code of Ukraine, “production, distribution, and sale of pornographic items” are punishable by a fine of 50 to 150 tax-free minimum incomes of citizens or arrest for up to 6 months, or restriction of liberty for a term of up to 3 years.

In this case, the fact that photos are exchanged or the consent of the participants is not taken into account. If the explicit images are discovered, the person who sent them may face criminal prosecution.

The lawyer expressed the opinion that such a practice is the wrong approach. In his opinion, adult content should be legalized, but with certain restrictions and rules.
