“Voluntary” fines in “Rezerv+”: recognition of a violation can protect against liability
Irregularity in the “Reserve+” application may not lead to the immediate imposition of fines, as noted by lawyer Darya Tarasenko in her publication on social networks.
The specialist emphasized that receiving a notification of a violation in “Reserve+” is only the first step in the procedure, and not a final decision on the fine.
Users in the “Online Fines” section can see a proposal to admit the violation. If the conscript activates the appropriate buttons, this is considered a voluntary admission of the fact.
The next stage is for the territorial recruitment center service to analyze the submitted application and make a decision. According to Tarasenko, there may be the following possible scenarios:
Imposition of a fine for UAH 17,000;
Closing the proceedings, if, for example, the term of liability expires;
Ignoring the submitted application, in which case no decision is made.
Therefore, even if a violation is recognized, a fine is not automatically imposed. If the proceedings are closed, then there is no need to pay.
If a decision is made to impose a fine, the user will receive a notification in the application that allows them to pay 50% of the fine (8,500 UAH) within 20 days of the decision.
