Deferred care: document validity periods and important information

The question of the validity period of the act certifying the fact of constant care has become relevant again. This document serves as a basis for obtaining a deferment from mobilization, but the legislation does not define clear terms of its validity.

The specified act of care, which is regulated by the Resolution of the Cabinet of Ministers No. 560, confirms the fact of constant care for a person who needs it, and gives the right to a deferment from conscription. This topic is clarified by lawyer Darya Tarasenko.

However, the document itself does not contain specific terms of validity. This has led to an ambiguous interpretation of the norms of the law by territorial recruitment and social support centers.

In some cases, the acts are recognized as indefinite, while in others, time frames are established: three months, six months or a year. Some centers are guided by the validity period of the conclusion of the medical advisory commission, which became the basis for obtaining the act.

The provided explanations indicate that the legislation does not clearly define the validity period of this document, but it is possible to indicate the term directly in the act itself.

It is also worth noting that the duration of the act cannot exceed the validity period of the conclusion of the medical advisory commission, confirming the need for constant care.

Therefore, the document remains valid as long as the medical conclusion is valid, and there are no circumstances that would deprive the person of the right to a deferment.

Citizens of Ukraine who have received a deferment from mobilization due to the need to care for a loved one and have traveled abroad with them are obliged to cross the state border only accompanied by this person.
