Who is prohibited from serving subpoenas: an important warning for men

Martial law and mobilization are still in effect in Ukraine. At this time, three types of summonses can be served to military conscripts: for data clarification, passing a military medical commission (MMC), and for direct dispatch to an army unit.

Persons who have the right to serve summonses:

representatives of the Territorial Recruitment and Social Support Centers (TCC and SP);
representatives of the structure of district and city administrations;
representatives of the executive bodies of village, settlement, and city councils;
representatives of institutions and organizations on their territory;
representatives of intelligence agencies, the SBU, and other relevant structures.
Legal experts emphasize that a person without the proper authority cannot serve a summons. Therefore, representatives of the territorial defense or police do not have the right to perform this function.

In what cases can a summons be refused

It is not allowed to refuse a summons without justified reasons. Conscripts must have real and valid reasons, although even they do not always guarantee avoidance of fines.

However, there are circumstances when it is possible to refuse a summons:

If a person hands over the document without appropriate authority,

If the document does not have a seal or signature of the commissioner of the CCC,

If the summons contains incorrect data on the person to whom it is addressed.

According to lawyers, a fine imposed for refusing to appear in court can be appealed. At the same time, representatives of the CCC and the SP must prove not only the refusal but also the fact of violating military registration rules. If a person is registered, has updated his information, has passed the VLK, and has no other violations, the chances of canceling the fine are high.
