Rules for serving subpoenas: when a summons to the CCC can be canceled
Ukraine is undergoing a general mobilization, within the framework of which men can be summoned to appear at the Central Military District.
The procedure for issuing and serving summonses must comply with legislative requirements for the document to be valid. This process is regulated by Resolution No. 560.
The summons must contain the following data:
last name, first name, patronymic, and date of birth of the person;
full name of the territorial (district) recruiting center;
purpose of the call to the center;
exact address, date, and time of appearance;
position, last name, first name, signature of the official who issued the summons, as well as the seal and date of signing;
unique registration number of the document;
warning of responsibility for failure to appear and the requirement to report the reasons for the absence.
If any of these items is missing, the document is considered invalid.
According to the law, summonses can be served not only by representatives of the Central Military District but also by other authorized personnel. Among the persons authorized to do this are:
representatives of local authorities;
heads of enterprises and institutions where the conscript works;
administrators of educational institutions;
managers of buildings, such as housing associations and condominiums;
officials of recruitment centers.
If the summons is provided by an unidentified person or is drawn up with a violation, it can be recognized as unlawful. In such a case, the person has the right to appeal the CCC’s decision in court or seek legal advice.
Earlier, it was reported about the possibility of postponing mobilization if the documents are still at the stage of preparation. Attention was also drawn to situations where a person did not pass the military medical commission due to illness, and it may be necessary to notify the CCC to avoid a fine. Recently, it has also become known that summons can be served to men with disabilities, and in such cases, it is essential not to ignore the call to the CCC.
