Who has the right to receive a second summons and the consequences of ignoring it?

Ukraine is amid general mobilization and martial law. According to the law, men who have not reported to their territorial recruitment centers may receive a second summons. Ignoring such a summons can have serious consequences.

According to Ukrainian law, conscripts are required to notify the CCC of any changes in their data within seven days. This applies to moving, changing jobs, marital status, and other circumstances.

In this regard, summons may be served again, in particular to undergo a military medical examination (if a year has passed since the last examination) or to update their data and grounds for deferment.

In the event of failure to fulfill the obligations established for conscripts, they may be temporarily prohibited from driving their car.

If summons are not fulfilled, the CCC has the right to apply to the National Police for administrative detention and forced delivery of the person. If this is impossible, a written request is sent. If this requirement is ignored within 10 days, the CCC will file a petition with the court for temporary deprivation of the right to drive vehicles.

However, such a restriction will not apply if the car is the only source of income or is necessary for caring for a disabled person.

Lawyer Roman Simutin noted that the CCC’s requirement is not a summons. These are two different legal terms, and the requirement is automatically considered served when sent by registered letter with notification of delivery to the person’s address.

It is also worth noting that failure to appear for a summons may result in administrative liability in the form of a fine, while evading mobilization is punishable by criminal penalties of up to three years of restriction of liberty or up to five years of imprisonment.

In addition, the government has adopted new rules for obtaining a deferment from mobilization for citizens with family circumstances. Now, new elements have been added to the list of required documents, and the requirements have become clearer.
