Who in November needs to confirm the right to deferment from mobilization

The Verkhovna Rada of Ukraine passed a decision to extend martial law in the country. Starting November 5, martial law will continue for another 90 days, requiring conscripts to have their status checked with a delay. Lawyer Darya Tarasenko reported this.

If the postponement was issued through the “Reserve+” platform, it is automatically extended for the period of the new mobilization. However, experts advise regularly checking the relevance of documents.

Those who received a deferment from the draft board (TCC and SP) usually do not need to take any action, except for academics and teachers. According to Resolution 560, within 5 days of the President’s decree on the continuation of the mobilization of the TCC and the SP, they must determine whether there are grounds to maintain the postponement.

But the procedure has its nuances:

• If the right to postponement is confirmed, TCC and SP update the information in the register.
• In the absence of grounds (for example, the loss of a relative for whom a deferment was issued), the documents are submitted to the commission for cancellation. This cannot be done by TCC and JV alone.
• If it is impossible to determine the validity of the right to postponement from the available documents, the TCC and SP are obliged to inform the conscript about the need to submit supporting documents, for example, in the event of the expiration of the conclusion of the LCC.

Darya Tarasenko emphasized that after receiving the notification, one should not delay in submitting the documents. Resolution 560 does not provide a clear answer on whether it is possible to mobilize a conscript before receiving confirmations. A quick submission of documents ensures the preservation of the right to postponement.

Earlier, it became known that the persons removed from the military registration can be returned to the base. Recommendations on preparing for the military medical commission were also published, and the issue of challenging the TCC’s actions was considered.
