Parents are expecting new restrictions that may lead to temporary removal of children

In Ukraine, there was a proposal to implement a new child protection scheme, which provides for the temporary deprivation of parental rights. This initiative was developed by the Ministry of Social Policy of Ukraine as an alternative to the existing system, which offers only complete and, as a rule, irreversible deprivation of rights.

The proposed restriction will be valid for three to six months. During this time, parents will have the opportunity to correct the situation that led to unsafe or inappropriate conditions for the child. This approach aims not only to protect the child, but also to promote the restoration of the family.

According to the new draft law, courts are obliged to consider cases of temporary deprivation of rights in the shortest possible time — no later than three days after the opening of the proceedings. The process can be initiated by guardianship authorities or prosecutors.

For the duration of the restriction, the child may be transferred to the other parent or to the custody of the state. To support the family, social services, psychological assistance and, if necessary, treatment or participation in special programs are provided.

One of the main advantages of this model is the possibility of returning the child to the family. If the parents confirm that they have improved their living conditions — have a stable income and are ready to fulfill their responsibilities, the court may decide to restore their rights.

When considering the case, the opinion of the child will also be taken into account, if he is able to express it, which corresponds to modern trends in the protection of children’s rights.

If the parents do not solve the problem, the period of restriction of rights can be extended or the complete deprivation of parental rights can be initiated.
