The court did not protect pensions: the elderly were again under threat

Ukrainian pensioners, who received a recalculation of their payments through the courts, are again threatened with delays in financing.

After the cancellation of the controversial resolution, the Ministry of Social Policy announced a new project, which, according to experts, largely repeats the previous provisions.

Attorney Tetyana Golitsa noted that this document is not fundamentally new, but is simply an improved version of the old resolution with a new number. According to her, this is a way to bypass previous court decisions and continue the controversial practice.

The main essence of the innovation is that payments based on court decisions are planned to be made in a separate queue. This assumes that citizens will be able to receive compensated funds only if there are free funds in the budget and without established payment terms.

Lawyers point out that this system effectively postpones payments indefinitely, despite the fact that the right to receive money has already been approved by court decisions.

Previously, attempts to limit payments were stopped by the court due to procedural violations, in particular, the absence of mandatory public hearings.

This time, the Ministry formally started the discussion process, however, representatives of the legal community note that technical problems of the site made it difficult for citizens to have access to the opportunity to express their opinions and comments.

The lawyer calls on pensioners to step up their actions by contacting the departments, because only under pressure from the public can one hope for changes in the final decision.

Experts warn: even if the project is rejected, the problem will not disappear, because the budget already has limited mechanisms for payments based on court decisions, which can also slow down the process of receiving funds.

Previously, it was said that pensioners will be given “bonuses” of UAH 900: the conditions and rules for receiving them. It was also announced that the verification of length of service for calculating pensions would be simplified and which pensioners would receive a 20 percent increase.
