Larysa Velychko, a lawyer and legal advisor, explained to Ukrainian media leaders that people can be drafted into the Armed Forces of Ukraine even if they are under investigation.

Under investigation? It depends on the court’s restrictions.

If a man is under criminal investigation but has not received a verdict, this does not exempt him from mobilization. It is essential to determine whether there are court restrictions, such as a travel ban, house arrest, or an obligation to report to law enforcement officers periodically.

“If there are no restrictions,” said Velychko,” such a person can be mobilized and, if they wish, sign a contract for voluntary service.

Who exactly will not be mobilized?

There are clear criteria for exclusion from mobilization. The military does not accept people with convictions for serious crimes, including murder, rape, and kidnapping. This also applies to people convicted of grave crimes, such as violating the territorial integrity of Ukraine.

Why is this important?

Today’s Ukraine is forced to use all available resources to defend itself, but it is trying to adhere to the principles of justice. Mobilization does not guarantee automatic exemption from liability, and being under investigation is not a guaranteed way to avoid a summons.
