A postponement does not protect against VLK: who can get into a medical board even with protection – a lawyer’s warning

Even though the deferment from mobilization officially recognizes the conscript as inseparable from passing the medical commission, there are exceptions when it may still be necessary to undergo a medical examination. Lawyer Vladislav Derii reported this.

The Military Medical Commission (MMC) is a crucial stage in assessing a person’s fitness for service. However, as the lawyer emphasizes, persons with a valid deferment are not subject to forced referral for a medical examination, which is strictly prohibited by law. In the event of an unjustified requirement to undergo the MMC, such a situation can be appealed.

According to Vladislav Derii, conscripts whose deferment terms have not yet expired should not receive summonses for a medical examination.

However, there are three legal grounds on which even persons with deferments can be referred to the MMC:

Service under contract. Citizens who independently conclude a contract with the Armed Forces of Ukraine are required to undergo a medical examination, regardless of the presence of a deferment.

Re-examination of fitness. If a person was previously recognized as being limitedly fit but did not undergo a re-examination, they may be referred to the VLK to confirm or change their status. However, if a person has an official disability, even in such cases, referral to the VLK is unlawful.

Own initiative. Any person liable for military service can voluntarily apply to the territorial recruitment center (TCK) with a request to undergo the VLK, for example, to update information about his health status or to appeal a previous decision.

If you receive a summons to the VLK during a legal deferment, it is essential to check its legality. Lawyers recommend keeping all documents that confirm the grounds for the deferment (medical certificates, guardianship documents, reservations, etc.) and, if necessary, seeking legal assistance.
