How to remove yourself from the wanted list of the CCC without paying a fine
Citizens of Ukraine who do not comply with the rules of military registration or ignore the requirements of mobilization legislation may be declared wanted. This procedure is regulated by Articles 210 and 210-1 of the Code of Ukraine on Administrative Offenses.
The reasons for such a step include failure to appear on call at territorial recruitment centers (TCC) after receiving a summons, unwillingness to undergo a military medical examination, untimely updating of registration data, or complete absence from military registration.
Although the law requires an official resolution for administrative violations, individuals may be automatically added to the wanted list without prior notification or a decision from the TCC.
A vivid example is the situation where a man who fails to appear at the TCC within seven days after reaching the age of 25 will be put on the wanted list on the eighth day. Another example is if a person does not appear for an electronic summons and the reason has not been recorded in the system within 14 days, such a person is automatically placed on the wanted list without any fines or administrative protocol.
Automatic inclusion in the wanted list causes legal misunderstandings. Since no decision formally confirms the violation, information about the “wanted” is already in the systems. This can create difficulties for citizens, for example, when crossing the border.
There are two possible ways to remove the wanted list. The first option is to file a lawsuit, as there are existing cases where the court has recognized such inclusions as illegal due to the lack of relevant resolutions. The second is to wait for the expiration of the period during which the person can be held liable. According to the law, a fine for a violation must be imposed no later than three months after its detection. If this period has expired, legal consequences are impossible, which gives grounds to challenge the wanted list information.
It is important to note that paying a fine does not automatically result in removal from the wanted list. Moreover, it may be interpreted as an admission of guilt, but it does not exempt one from the obligation to appear in the CCC in the future. Individuals remain in databases like “Oberig” or other Ministry of Internal Affairs systems.
