New mobilization rules: who has the right to “cancel” the decision of the VLK

A new problem has arisen in Ukraine related to mobilization. It turned out that even after passing a military medical commission, mobilizers may face refusals to accept them into military units. This was reported by lawyer and human rights activist Daria Golodnyak.

According to her, if a military unit refuses to accept them, this must be officially documented. If the command determines that the mobilizer is unfit for service due to health conditions, an appropriate action is taken. After that, the mobilizer must undergo a re-examination at the medical and social examination centers (MSCs) within three days.

Golodnyak drew attention to the fact that similar situations have happened before: a person can be recognized as fit for service, and then be refused by the military unit. As a result, he finds himself in an uncertain state, without a clear status.

The lawyer also clarified that the new rules approved by the Ministry of Defense are designed to solve this problem. In the event of an official refusal by the unit, the decision of the VLK can be easily reversed, and the person is sent for a reassessment of their state of health, taking into account all relevant medical issues.

However, the human rights activist noted that the practical application of this mechanism remains questionable. Although formally it is designed to protect the rights of the conscript, time will tell whether it will simply become a reason for endless checks between military units and the VLK.

Thus, people with health problems who are mobilized may have a chance to avoid unjustified conscription, but they risk falling into a vicious circle of checks and repeated examinations.
