Lawyers warn about important nuances of passing the VLK that can lead to problems
Citizens of Ukraine who received a referral to a military medical commission (MMC) not through a territorial recruitment center are theoretically able to choose a medical institution for examination at their own discretion. However, in practice, this often causes problems.
One of the citizens approached lawyers with a question about whether it is possible to undergo an MMC at a hospital other than the one specified in the MMC referral.
Lawyer Andriy Brylyov emphasized that this possibility is enshrined in law, but the mechanism for its implementation remains imperfect. According to official explanations from the Ministry of Defense, a conscript can independently choose an institution, since the electronic referral does not contain a specific institution. However, in real life, this norm is often not correctly implemented.
Causes of complications
Experts note that, in most cases, a person cannot independently choose an examination institution. Lawyer Vladislav Derii clarified that even if a citizen tries to contact another medical institution, he may be sent back to a hospital assigned to the relevant regional CCC for additional examinations. When there are no suitable conditions for treatment or diagnostics in a given city, the VLK doctor may refer the patient to an officially designated hospital.
Possible consequences
Lawyer Yuriy Ayvazyan warned that attempting to avoid fulfilling the requirements and undergoing VLK at an unapproved hospital can lead to serious consequences. If a conscript undergoes an examination in an unapproved medical institution, the results may be invalidated, and the entire process will have to be repeated.
