Urgent check of “Diya”: TCC has started a new distribution of fines to Ukrainians
Recently, it has become a long-standing practice for many men to receive notifications in the Diya application about the opening of enforcement proceedings and the seizure of funds on bank accounts. Lawyer Ruslan Tkachenko told how to act in such a situation.
The lawyer noted that such cases usually arise when individuals fail to appear at the territorial recruitment center (TCC) to verify their data or undergo a medical examination. In turn, the TCC has the authority to impose fines in absentia, without prior notice to conscripts. After issuing the resolution, this document is sent to the State Executive Service for enforcement.
Executors, having received the resolution, open executive proceedings. This leads to an automatic doubling of the fine—from 17,000 hryvnias to 34,000 hryvnias —and, a day later, it is possible to seize bank accounts to debit this amount.
Tkachenko recommends submitting a lawyer’s request to receive a copy of the resolution as soon as possible. The deadline for filing an appeal against the decision begins when it is received. The lawyer emphasizes that the administrative decision in itself is not indisputable evidence of a violation.
To confirm proper service of the summons, official documents are required, such as a registered letter with a description of the attachment, a notice of service, or a certificate from “Ukrposhta” stating the reason for the return. These references are essential, for example, if the person refuses to receive a summons or does not live at the specified address. The lack of such evidence can serve as grounds for canceling the fine in court.
