Is it possible to get a deferment for violations of military registration: details of the situation

Failure to comply with the rules of military registration in Ukraine can lead to both administrative and criminal liability. However, this is not the reason for an automatic refusal to grant a deferral from mobilization.

Lawyer Darya Tarasenko shared a case from her practice. In one case, a man who constantly cares for his sick mother was faced with a refusal to grant a deferral due to a previously recorded violation of the rules of military registration.

However, the court found the decision of the territorial recruitment and social support center (TCK and SP) unlawful and ordered that it reconsider his application.

The verdict clearly shows that although a violation of the registration rules may have consequences, this is not a basis for automatically rejecting his request for a deferral from conscription under mobilization conditions. Thus, the TCK does not have the right to refuse a deferral without reason, even in the presence of previously committed violations, if there are legal grounds for obtaining it.
