Ukrainians may have their gardens taken away: who is in danger of losing their land?

In Ukraine, the issue of using land plots that are not privatized becomes increasingly crucial during martial law. Although the privatization process of most land ownership has been temporarily suspended, citizens still have the right to use it. However, this right requires proper documentary confirmation and compliance with legal norms.

Experts from the law firm “Land Fund of Ukraine” note that the introduction of martial law has postponed the transfer of land to private ownership. This was done to protect state resources under challenging conditions. Therefore, land owners cannot begin or complete the procedure for registering land rights during the period of martial law. However, the current practice of using the plot cannot be stopped without legal grounds.

“The fact of using the land is an important argument in your favor, and you can only be deprived of this right through a court or in accordance with legal procedures,” the lawyers emphasize. Owners must be prepared to provide evidence of the plot’s legal cultivation and the relevant documents.

To avoid risks, experts recommend checking previously issued documents from local authorities, such as a decision on the provision of a plot of land for use, a land act, or an agreement on use or a long-term lease. In the event of loss, you can contact the local council to obtain official confirmation of your rights to use the land.

In addition, it is essential to collect evidence of the land plot’s actual use: photos, videos, inspection reports, and testimony from neighbors. This will help prove the continuity of use of vegetable gardens and provide legal support in the conditions of martial law.

At the end of martial law, restrictions on land privatization will be lifted, allowing owners to register land rights. Temporary measures do not deprive citizens of their right to use the plots, but only delay the official registration of their rights.
