Wanted from the CCC: when it ceases to be valid, lawyers explain

In Ukraine, questions are increasingly being raised about the “search” from territorial recruitment centers. Can this process continue indefinitely? How will it lose its force, and what to do if the wanted status does not disappear, lawyers explain.

According to experts, such a search cannot last forever. Violations of the rules of military registration are classified as administrative offenses, with clear deadlines for bringing them to justice.

According to the Code of Ukraine on Administrative Offenses, an administrative penalty can be imposed within 3 months of the violation being detected, and the general term is 1 year.

Lawyer Serhiy Koshel emphasizes that there is no term “administrative search” in Ukrainian legislation in the context of the CCC’s activities. He notes that the search should be applied only within the framework of criminal proceedings against persons with the status of a suspect.

“The wanted person has no statute of limitations and does not disappear automatically. However, if a year has passed since the violation, the CCC can no longer hold them accountable, and the wanted person becomes illegal and can be appealed in court,” Koshel notes.

In some places, citizens have to remind themselves about the expiration of the terms. People can contact the CCC to request cancellation of the wanted person status if the terms have already expired.

Lawyer Karina Romanyshyn notes that the electronic service “Reserve+” complies with these legal norms, so the “wanted person” status in the application can automatically disappear after a year. However, in practice, the status is often not updated.

“Sometimes the ‘wanted person’ may be in a ‘suspended’ state, but let the user simply try to update the document,” she explains.

Lawyers also remind us of several important points: the CCC cannot impose fines for the same case of violation. In case of new violations, a separate fine may be imposed for each case.

It is also worth remembering that the expiration of the deferral period is not a basis for automatic “wanted” or mobilization. However, the CCC may transfer information to the police for further explanatory work regarding military registration or a medical commission.

You can check whether a fine is outstanding with the CCC by sending a request to the territorial center or using electronic services. If the wanted status arose in error, the person has the right to apply for its cancellation.
