Do the CCC have the right to detain military personnel in the North-West Frontier Province: official clarification
After the MP’s statement about possible detentions of servicemen in Kyiv, representatives of territorial recruitment centers clarified their powers. They emphasized that only the Military Law Enforcement Service is engaged in the search and detention of persons who have left a military unit without permission.
A discussion arose in Kyiv regarding the role of law enforcement officers and territorial recruitment centers in the detention of servicemen who have left a military unit without permission. The statement of MP Oleksandr Fedienko about the detention of such persons with the participation of the Military Law Enforcement Service and the police became an occasion for discussion.
The Kyiv City Territorial Recruitment and Social Support Center reported that their employees do not have the right to detain servicemen. This function belongs exclusively to the Military Law Enforcement Service.
At the same time, the Military Law Enforcement Service explained that their representatives can, together with the police, carry out measures to notify the population and check military registration documents. If a person is found to be in the SZCH, the actions depend on the behavior of this person.
According to the press service, police officers may offer a serviceman to voluntarily report to a unit of the Military Law Enforcement Service. If a person resists or tries to evade lawful demands, law enforcement officers have the right to detain in accordance with the law.
Earlier, the Minister of Internal Affairs Ihor Klymenko also emphasized that the National Police acts within its legal powers. The right to detain can be exercised only if there are appropriate legal grounds.
Thus, the official position indicates: the CCC does not detain servicemen, and their functions are limited to checking documents and informing.
Earlier, it was reported that from March 1, new legislative norms regarding unauthorized leaving of a military unit came into effect in Ukraine. Now the absence of a serviceman on duty without a good reason for more than three days is considered a criminal offense.
