Possibility of obtaining a deferral with the status of “wanted”: clarification from a lawyer

Problems with the territorial recruitment center and the “wanted” status do not always deprive the right to deferment from military service. Legal grounds can be used if the documents are submitted properly.

Lawyer Oleksiy Shalar from Odessa notes that the “wanted” status does not affect the possibility of receiving a deferment. The right to a deferment should be considered regardless of the situation with military registration, even if there are fines or wanted status. For example, the inability to update data in a timely manner does not cancel the right to a deferment.

“Your wanted status does not limit the right to a deferment. If you have the right, you have it. This issue should be considered separately from the reasons for your status,” the lawyer emphasizes.

Today, the procedure for submitting documents for a deferment has changed. They can be submitted in person through the Center for Administrative Services or in electronic format, after which the CCC reviews and makes a decision.

Reasons for the “wanted” status

The reasons for the “wanted” status can be different. According to the lawyer, if after receiving the status a person acquires legal grounds for a postponement, then this right remains. Such situations are not uncommon. For example, he could have had problems with the CCC, but his circumstances have changed, which allows him to receive a postponement.

“If there is a fine that was not appealed, and the statute of limitations has expired, and the person has received a summons, then even while being wanted, he must submit documents if the circumstances have changed, for example, a child was born or a disability has been acquired,” Shalar clarified.

He also added that often problems arise not due to the lack of the right to a postponement, but due to shortcomings in the documents, an incomplete package or errors in the registers. Therefore, it is important to check all certificates before submitting, because even technical errors can cause a refusal.

Earlier, it was reported about the intensification of mobilization measures in Kyiv. In addition, the issues of legitimacy of summonses to medical commissions and fines for parents for registering children with the CCC were discussed.
