You can receive your husband’s pension after his death: clarification for pensioners

A husband or wife is entitled to receive a pension for the deceased if they have reached retirement age and have been living together continuously until the deceased’s death.

In this case, they can count on 50% of the deceased’s pension, which is referred to as the survivor’s pension.

To apply for this payment, you must contact the Pension Fund. First, you need to obtain confirmation that the person was dependent on the deceased. This may be a document from the local authorities. If such confirmation is not provided, you will need to go to court.

To apply with the court, you should prepare the following documents:

A copy of the death certificate;

a marriage certificate;
documents confirming the fact of support (for example, correspondence, income certificates, pension payments);
evidence that the deceased’s assistance was the primary source of livelihood (receipts and other documents);
a certificate of refusal by local authorities to issue a certificate of support.
After receiving confirmation of support, you must submit an application to the Pension Fund for the appointment of a pension.

In addition to spouses, such pensions can also be claimed by:

Parents of the deceased;

Children under eight years of age or older if they became disabled before reaching this age;

Full-time students up to 23 years of age.

If several people are entitled to a pension, 100% of the pension is divided equally between them.

The law recognizes spouses of retirement age as disabled family members; therefore, in the event of the loss of the breadwinner, they are entitled to a pension.
