The CCC has prepared a trap for drivers: if you don’t have time to look around, you’ll lose your license – how to protect yourself

In recent days, social media has been actively discussing the issue of returning driver’s licenses that were confiscated from men for evading military service. According to the latest comments by lawyer Tamila Aleksik, conscripts must contact the territorial recruitment centers (TCKs) to update their data to regain their rights. She explained the conditions under which a driver’s license can be confiscated and how it can be returned.

The seizure of driver’s licenses is possible only based on a court decision. According to the expert, the actions of the TCK or law enforcement officers without a court decision are considered illegal.

The right to restrict the driving of vehicles arises only in cases where a person intentionally evades military service, for example, by ignoring summonses or failing to update their credentials within the established deadlines.

In such situations, the head of the TCK must contact the police to request assistance in locating the person. The police have 5 days to fulfill this request. If the person cannot be found, the CCC sends a request by mail. If the person does not appear at the CCC within 10 days of receiving the request, the military registration and enlistment office may file a lawsuit to restrict their right to drive a car.

The lawsuit must be filed within the current regulations. In the event of errors or violations in the application form, the court leaves the documents without action. If the procedure is followed, the court may decide to temporarily revoke the driver’s license until the obligations stipulated by the law on mobilization are fulfilled.

However, if the driver’s license was revoked without a court decision, for example, at a checkpoint, this is a violation of the law. In such cases, a citizen has the right to challenge the actions of the CCC or police officers in court. Such actions may be qualified as abuse of authority, especially in situations where the person is not wanted and was admitted to the base by mistake.

If the license was seized legally, that is, by court decision, its return is possible only after fulfilling specific requirements:

updating the registration data in the CCC;
passing the military medical commission, if there is a referral.
After that, the CCC submits the documents to the enforcement service, which then returns the license to the owner. The seized rights are stored in the central office of the patrol police and are returned through the enforcement service after the completion of the enforcement proceedings.
