CCC investigation: what consequences may await those liable for military service
In Ukraine, conscripts can be declared wanted on the initiative of territorial recruitment and social support centers (TCK and SP), which leads to their detention by the police and forcible delivery to the appropriate center.
Lawyer Maryna Bekalo explained this procedure in detail in a comment for TSN.ua.
According to Ukrainian legislation, conscripts who ignore mobilization requirements can be declared wanted upon the submission of the TCK and SP. This submission is mandatory for law enforcement agencies, which are obliged to detain the person and deliver him to the TCK.
This is about administrative, not criminal, liability. Detention can occur in the event of violation of military registration rules, failure to appear on a summons, or failure to comply with other requirements of defense and mobilization legislation.
Maryna Bekalo emphasized that the purpose of such detention is to draw up a protocol on an administrative offense. After the offender is delivered to the CCC, the “wanted” status will be removed, since the completed application is entered into the database of the Ministry of Internal Affairs, and the relevant services are obliged to respond to this as soon as possible.
How to find out the reasons for the wanted announcement?
The presence of grounds for applying coercive measures is always indicated in the CCC’s message to the police; usually, these are:
violation of the rules of military registration;
failure to appear on a summons;
evasion of a medical commission;
other violations of mobilization legislation.
However, specific information about the case can only be provided by the CCC and the SP upon written request or during a personal appeal.
Thus, a wanted announcement initiated by the CCC does not necessarily lead to criminal prosecution, but rather to serious legal consequences, such as detention by the police, forced delivery to a recruiting center, and registration in the Ministry of Internal Affairs’ databases.
