Disability is not exempt from CCC requirements: those with limited fitness are subject to mobilization

Since May 2024, a new Law No. 3621-IX has been in effect in Ukraine. This law eliminates the status of “limitedly fit for military service.” Men who previously had this status must undergo a repeated military medical examination. However, this requirement has caused legal confusion in the interpretation of the law’s provisions.

According to paragraph 2 of the Final and Transitional Provisions of the new law, persons previously recognized as limitedly fit must undergo a repeated medical examination by February 5, 2025. This examination aims to update the conclusion on their fitness for service under the new legislation.

Other existing regulatory legal acts complicate the situation. For example, the Cabinet of Ministers’ resolution prohibits sending persons with disabilities to medical examinations, which conflicts with the law’s requirement that they undergo repeated examinations.

Lawyer Andriy Topchiy notes that there is a legal conflict in this situation. According to him, the law does not oblige a person to initiate the passage of the VLK independently. You do not need to apply if the military commissariat (MCC) does not summon you. However, if you receive a summons, the expert advises you to go through the commission without entering into legal disputes.

Thus, if you had the status of “limitedly fit” until May 2024 and have an established disability, you do not have to initiate the MLC yourself. However, having received a summons from the MCC, you should appear for the commission, even if it seems optional.
