25-year-olds are subject to mobilization, postgraduate studies are not a reason for dismissal, explains lawyer

In Ukraine, upon reaching the age of 25, men are no longer classified as conscripts.

Lawyer Yuri Aivazian noted that postgraduate students studying full-time have the right to defer mobilization, but this is only possible if certain conditions are met.

Usually, the change of status in the register “Oberig” is automatic, but to obtain confirmation, it is recommended to contact the territorial center of acquisition (TCC) in person. Although the re-passing of the Military Medical Commission (VLK) is not formally binding, in practice, the Tax Code often requires it, even for those who are entitled to deferral.

Delayed design can be performed through the e-cabinet “Reserve+,” provided the status is updated. If the status is not updated, you must apply in person or through mail. In some regions, for example, in Kyiv, it is possible to apply through administrative services (CNAP) if the CCC has given such powers.

To obtain a postgraduate student’s deferral must be provided:

certificate with EEBO with the indication “Yes, does not violate”;
copies of passport, RKOPP, prescribed or military accounting document;
A statement of deferral was issued by Annex 4 to CMU Resolution No. 560.
You must first submit an application by mail to the shopping center to express your intention to exercise the right to defer. Upon confirmation of delivery, you must submit the documents in person in two copies, one of which will be retained with the signature of the reception staff.

The lawyer may be present during the submission of documents, but the CCC may refuse to be admitted, referring to the “regime object.” Although the presence of a lawyer does not guarantee success, it can help fix the process and protect the rights.

If your delay statement is not accepted or you refuse to register it, do not sign the mobilization order. In this case, it is essential to document this refusal and note that you have not been allowed to exercise the right to defer.

It should be remembered that the CCC is doing its work. If the war had not started, the CCC staff would not have needed to issue summons.

If we do not protect our country, the aggressors will come to our homes and make us fight for our safety to kill others in Europe. We are inevitably fighting at odds, but now we can choose which side to stand on. There are also mass mobilizations in the occupied territories, which can have serious consequences.

The Armed Forces of Ukraine are struggling, giving their lives for the civilian population, so each of us should assist the military by volunteering, preparing, or supporting acquaintances who serve. Only through joint efforts can we defeat the aggressor and reach peace.
