CCC fines in 2026: under what conditions is a punishment considered illegal and the case should be closed

Can fines for summonses be indefinite?

Lawyer Yuriy Ayvazyan notes that fines for violating military registration rules are subject to time limits. Territorial recruitment centers do not have the right to hold accountable when it is beneficial to officials, because the law clearly defines the time limits.

The lawyer refers to Article 38 of the Code of Ukraine on Administrative Offenses (CUaPA), which governs the imposition of penalties, including during martial law.

What terms apply during martial law?

A special procedure has been established for violations specified in Articles 210 and 210-1 of the Code of Administrative Offenses. A fine may be imposed:

no later than three months from the moment the violation is detected;

but no later than one year from the date of the violation itself.
If at least one of these deadlines has expired, then the prosecution will be illegal.

What to do if the CCC is late?

In the event of missing the deadlines, the CCC is obliged to close the proceedings rather than continue them. This is expressly provided for in Article 247 of the Code of Administrative Offenses, which prohibits consideration of cases if the statute of limitations has expired.

It is also not allowed to open new proceedings on “expired” facts.

Does the CCC have the right to detain a person?

The lawyer emphasizes that if the statute of limitations has expired, there are no legal grounds for detention. In such cases, representatives of the CCC do not have the right to forcibly deliver a person to the recruitment center for the purpose of preparing a report or issuing a fine. Any forceful actions in such a situation will be legally unjustified.

Thus, in 2026, the issue of fines from the CCC will depend not only on the violation itself, but also on compliance with the established deadlines. If the deadlines specified by law have expired, liability cannot be imposed, and the case will have to be closed.
